1. Subject matter

These General Terms and Conditions of Sale govern the purchase of goods and/or services carried out remotely, via the computerised network on the website https://www.saturniagift.com of Terme di Saturnia S.p.A., with registered office in Località Follonata snc, Saturnia, Manciano (GR) – 58014, Tax Code and registration number with the Grosseto Companies’ Register 11988870157, VAT number 01244760532.

Each online purchase transaction shall be governed by the provisions of Legislative Decree no. 70/2003 (concerning the rules on electronic commerce), referred to in Leg. 29/2010 (concerning the rules on services in the internal market), in D. Lgs. 196/2003 and subsequent amendments and additions (Privacy Code) and pursuant to Leg. n. 206/2005 (Consumer Code) if the user falls into that category.

For all matters not expressly governed by these General Terms and Conditions and by the aforementioned legislation as well as for provisions that cannot be derogated from by agreement between the parties, the provisions of the Civil Code shall apply.

2. Acceptance of General Terms and Conditions

The users, by telematically sending confirmation of the purchase order, unconditionally accept and undertake to comply with the general conditions and payment terms set out below in dealing with Terme di Saturnia S.p.A., declaring that they read and accepted all the indications provided in accordance with the above-mentioned regulations.

3. User Commitments

The General Terms and Conditions of Sale must be examined online by users when consulting https://www.saturniagift.com, by ticking the relevant box, before a purchase can be confirmed. Submission of the order confirmation therefore implies full knowledge of the General Terms and Conditions of Sale and their full acceptance.

4. Conclusion of the online purchase contract

The purchase order sent via the Terme di Saturnia S.p.A. website constitutes a simple contractual offer that Terme di Saturnia S.p.A. reserves the right to accept.

It is the user’s responsibility to check whether the amount indicated for the chosen services and/or goods is correct before placing the order.

Payment by the user in the manner set out below is a necessary condition for the completion of the purchase of goods and/or services.

The respective contract is concluded upon receipt of an e-mail summarising the ordered goods and/or services and any further contractually relevant elements (vouchers), at the e-mail address indicated by the user.

5. Payment Conditions

Payment will be made using the payment options chosen by the user from among those provided on the website, during the online purchase procedure.

Prices shown include VAT, if due.

6. Terms of Service Provision

The use of the purchased voucher will take place in the terms set out on https://www.saturniagift.com/redeem-policy/

Vouchers are valid for a period of one year from the date of issue, after which the right to use the goods and/or services expires. No refund is due for unused goods and/or services.

In the event of loss, theft, damage, non-use or expiry of the voucher, the user shall not be entitled to a refund.

7. Cancellation and Refunds

It is mandatory to give notice of cancellation at least 48 hours prior to the scheduled date of use of the good and/or service, otherwise the right to use the voucher will be forfeited.

9. Jurisdiction

This contract shall be governed by Italian law. For any dispute concerning the validity, interpretation or execution of the same contract, the territorial jurisdiction is the Court of Rome, or, in the case of a consumer, the court most favourable to the latter.
